Panel topic: Constitutional democracies in Europe struggle with the changing attitudes of citizens towards the legitimacy of their institutions. Legal actions by civic actors appear as a key component in the changing authority of governance actors. These include standard uses of legal procedure, such as strategic litigation, but the panel also addresses more informal law-based strategies, such as direct action through mass protest. Regarding the rule of law from a law-in-context approach, we focus on the relationship between civic actors and constitutional powers and investigate tensions between citizens and government institutions in rule of law terms.
The panel’s focus is on our understanding of the mobilization of law by civic actors, the relationship between mass protest and individual action, cultural oppositions and legal education, and the appeal to the rule of law in the Brexit process as a case study.
