Abstract
This article examines the extent to which Dutch legal practice in the criminal assessment of physical violence by the police aligns with the case law of the European Court of Human Rights (ECtHR). According to the ECtHR, police violence must be absolutely or strictly necessary due to the behavior of the individual in question, and the investigation into police violence must be independent. Dutch legal practice appears to contain multiple elements that do not comply with this case law.
