Abstract

This paper discusses the possibilities of identifying common minimum standards for assessing ongoing judicial reforms in new member states of the European Union. The model of optimal balancing between classic rule of law and New Public Management principles — amended by the balance between principles increasing input and output legitimacy — is argued to provide more insight for this legal dilemma. Measures targeting case management as part of the ongoing judicial reforms in Hungary are used as a case study.
