Abstract
Submitted by the Competition & Sustainability Commission of Recht voor Klimaat as part of the European Commission’s in-depth consultation on the revision of the EU Merger Guidelines (Topic D: Sustainability and Clean Technologies). The submission argues that sustainability efficiencies and public-interest considerations should be more systematically integrated into EU merger control, and highlights the relevance of out-of-market benefits, externalities, and environmental principles in the assessment of mergers and remedies.
