Regulating the Regulators: Can App Stores Strengthen Privacy in the Mobile Ecosystem?

Abstract

The influence that Apple and Google have in the mobile ecosystem is unambiguous: both companies control the major app stores, the Apple App Store and the Google Play Store, as well as the main mobile operating systems, iOS and Android. Through contractual arrangements, technical standards and enforcement, app stores can set the rules for entering their ecosystems. Since developers have few alternatives to distributing their apps in the EU outside of the Apple App Store or Google Play Store, these rules are extremely influential. App stores act thus as gatekeepers which puts them in a great position of enforcing rules – which lead some authors to frame them as exceeding the power of public regulators like data protection authorities and de-facto privacy regulators.
