The legal implementation of distributive and procedural justice considerations for a just transition

Abstract

The argument of this chapter is that the concept of a just transition can only be understood fully once all governance levels, including the local one, have been considered. Using the example of the Act on the Participation of Citizens and Municipalities in Wind Farms in Mecklenburg-Western Pomerania, we examine the means by which a distributive and procedural justice framework that governs the energy transition can be implemented in law. The chapter introduces the concept of a just transition and two of its tenets, distributive and procedural justice. We then elaborate on the example of the Act on the Participation of Citizens and Municipalities in Wind Farms in Mecklenburg-Western Pomerania.
