Abstract
Because of the dependence on the contract of sale and the behaviour of seller en buyer, a right of pledge to a document of title such as a bill of lading provides less securtity than a right of pledge to the goods themselves. The dependence of the pledgee on the contract of carriage can be far worse. A better instrument of security could perhaps be found in arranging that possesson and ownership op the bill and cargo would go from the seller in the hands of a custodian who could then hold the documents for all interested parties..
